CEZAEVİ OMBUDSMANLIĞI: ABD VE İNGİLTERE SİSTEMLERİNİN KARŞILAŞTIRMALI ANALİZİ

Abstract

Cezaevi ombudsmanlığı, mahkûm haklarının korunması, cezaevi koşullarının iyileştirilmesi açısından önemli bir denetim mekanizmasıdır. 20’nci yüzyılın ortalarından itibaren ombudsmanlık sistemi, birçok ülkede insan hakları ihlâllerini önleme ve cezaevi yönetimde hesap verebilirliği sağlamayı hedeflemiştir. ABD’de eyalet düzeyinde, İngiltere’de ise merkezi bir yapılanma göstermektedir. Her iki sistem de mahkûm şikâyetlerini ele alma, insan hakları ihlâllerini önleme ve rehabilitasyon süreçlerinde önemli rollere sahiptir. ABD modelinde farklı yerel uygulamalar avantaj sağlarken, İngiltere modelinde sürece göçmen geri gönderme merkezlerinin dahil edilmesi ve gözaltında ölüm olaylarının soruşturulması yapıyı daha etkili hâle getirmektedir. Makalede, her iki modelin benzer ve farklı yönleri incelenmiş, uygulamaya dair örneklere yer verilmiştir. Cezaevlerinin insan onuruna yakışır bir standarda kavuşturulması, iyi yönetişim ilkelerinin ve bağımsız denetim mekanizmalarının benimsenmesiyle mümkündür.

Prison Ombudsman:A Comparative Analysis of the U.S. and England’s System

Abstract

Prison ombudsman is an important oversight mechanism to protect prisoners' rights and improve prison conditions. Since the mid-20th century, the ombudsman system in many countries has aimed at preventing human rights violations and ensuring accountability in prison administration. It is organised at the state level in the U.S. and at a centralised level in England. Both systems have important roles in handling prisoner complaints, preventing human rights violations and rehabilitation processes. In the U.S. model, different local practices provide advantages, whereas in English model, the inclusion of immigration removal centres and the investigation of deaths in custody make the structure more effective. In this article, similar and different aspects of both models are analysed and examples from practice are given. The restoration of prisons to a standard befitting human dignity is possible through the adoption of good governance principles and independent oversight mechanisms.
