The Theoretical Framework of Proxy Wars And Their Evaluation In Terms Of International Law

Abstract

Proxy wars are armed conflicts between states or non-state armed groups without direct military intervention, usually as a result of regional or global power struggles. This article discusses the theoretical framework of proxy wars and evaluates their definition, the difficulty of defining them, their components, and their advantages and disadvantages. In addition, a general evaluation of proxy wars in terms of international law is made. At this point, a general assessment of proxy wars is made in the context of the law of international responsibility of states and the basic purposes and principles of the United Nations Charter, based on the case decisions examined before the International Court of Justice. In this study, which is a research article, the case study method was used and the data collected from the literature were analysed through content and document analysis. In this study, it is seen that proxy wars have serious advantages for states as well as some disadvantages, but there is no clear attitude of international law towards proxy wars.

Vekâlet Savaşlarının Teorik Çerçevesi ve Uluslararası Hukuk Açısından Değerlendirilmesi

Abstract

Vekâlet savaşları, doğrudan askerî müdahalede bulunmaksızın, devletler veya devlet dışı silahlı gruplar arasında, genellikle bölgesel veya küresel güç mücadelelerinin bir sonucu olarak gerçekleşen silahlı çatışmalar olarak karşımıza çıkmaktadır. Bu makalede, vekâlet savaşlarının teorik çerçevesi ele alınarak; tanımı, tanımlanma zorluğu, bileşenleri ve sahip olduğu avantaj ve dezavantajları değerlendirilmektedir. Ayrıca, vekâlet savaşlarının uluslararası hukuk açısından genel bir değerlendirmesi yapılmaktadır. Bu noktada, vekâlet savaşlarının devletlerin uluslararası sorumluluğu hukuku ve Birleşmiş Milletler Antlaşması’nın temel amaç ve ilkeleri bağlamında Uluslararası Adalet Divanı önünde incelenmiş dava kararlarından yola çıkarak genel bir değerlendirme yapılmaktadır. Bir araştırma makalesi olan bu çalışmada durum çalışması yöntemi kullanılmış, alan yazından toplanan veriler içerik ve döküman analizi ile ele alınmıştır. İşbu çalışmada; vekâlet savaşlarının devletler için ciddi avantajlar ile beraber birtakım dezavantajlara sahip olduğu görülmekle beraber, vekâlet savaşlarına uluslararası hukukun net bir tavrının bulunmadığı görülmektedir.
